This agreement is between you, the practitioner, and CymaTones (“CymaTones”, “we”). It covers your use of CymaTones Practitioner: the practitioner portal, the client Wellness Packets, your practice page and the related tools (the “Platform”).
Please read it carefully. By accepting it you agree to these terms and to the CymaTones Code of Ethics & Conduct, which is part of this agreement.
1. What CymaTones provides
- CymaTones provides the Platform: software and wellness tools (such as frequency plans, nutrition, movement, sleep and wellness content, supported scans, check-ins, messaging, scheduling, video sessions, branded pages and AI-assisted drafting) that you can use to support your own clients.
- CymaTones provides the platform and tools only. We do not provide your services, see your clients, or run your practice.
2. Your independent practice
- You run your own independent business. You are not an employee, agent, partner, franchisee or representative of CymaTones, and nothing in this agreement creates that kind of relationship.
- You alone are responsible for your practice: your services, advice, sessions, care and results; your client relationships and communications; client consent and records; your pricing, billing, refunds and taxes; your insurance; and any licenses, registrations or qualifications your work requires where you practice.
- CymaTones is not a party to the relationship between you and your clients. Your clients are your clients.
3. What CymaTones is not responsible for
To the fullest extent the law allows, CymaTones is not responsible for: the services, advice, care, outcomes or results you provide or your clients experience; any harm, injury, loss, dispute, complaint or dissatisfaction between you and a client; your conduct, claims, marketing or representations to clients or the public; or your compliance with the laws, regulations and professional rules that apply to your practice.
4. Wellness, not medical care
- CymaTones tools are for general wellness and relaxation. They are not medical devices and are not intended to diagnose, treat, cure, mitigate or prevent any disease or condition.
- You agree not to present CymaTones, its tools, your programs or your services as medical care, and not to claim or imply that they diagnose, treat, cure or prevent any condition. You will not tell a client to stop, change or delay medical care or medication.
- You will encourage clients to consult a doctor or other qualified professional for medical concerns, and refer them on when something is outside your scope.
- CymaTones makes no promise or guarantee of any wellness outcome or result, for you or your clients. You deliver your services at your own responsibility.
5. Your qualifications and how you represent yourself
- You will describe your training, qualifications and experience honestly and accurately.
- CymaTones does not license, certify, accredit, verify or endorse practitioners. You will not claim or imply that CymaTones has licensed, certified or medically qualified you, or that using the Platform makes you a medical or licensed professional.
- Where your work requires a license or registration in your location, you are responsible for holding it and working within its scope.
6. The Code of Ethics & Conduct
You agree to follow the CymaTones Code of Ethics & Conduct (integrity, client privacy and confidentiality, honest and non-medical practice, professional conduct and boundaries, and representing CymaTones well). It is part of this agreement, and serious or repeated breaches may lead to suspension or termination.
7. Your clients’ data, privacy and consent
- You decide what client information you collect and why, and you are responsible for having your clients’ informed consent and a lawful basis to collect, store and use it, and for honoring their privacy rights under the laws that apply to you (for example data protection and health-privacy laws).
- Keep client information confidential. Don’t share it, or any client’s story, photos, results or identity, in marketing, on social media, in the practitioner community or anywhere else without their explicit, informed permission.
- Keep your login secure, don’t share it, and only give practice access to people who need it. Tell us promptly if you suspect unauthorized access to your account or your clients’ data.
- Upload only content you have the right to use.
8. How CymaTones protects your data
- Your practice is its own private space. Every practice’s records are isolated at the database level, so only the people in your practice can read your clients’ information.
- Your client data is kept separate from anyone’s personal CymaTones account, including your own.
- Private files (scan photos, documents, voice notes) live in private storage. They are never public and open only through short-lived secure links.
- Data is encrypted in transit and at rest by our hosting providers.
- Each client’s Wellness Packet opens only through its private link, which you can turn off or replace at any time.
- We never sell your data or your clients’ data, and we never market to your clients.
- CymaTones staff access practice data only when needed to support you, keep the platform secure, or meet a legal obligation.
- We process your practice’s data to provide the Platform to you, on your instructions, and as described in our Privacy Policy.
9. Your data when you leave: export or delete
- Your data is yours. Export your practice and client records whenever you like: everything in one download, or your clients as a spreadsheet.
- If you cancel, your practice is kept for 30 days so you can export your data or change your mind and reactivate.
- After those 30 days, your practice and client data (records, notes, programs, packets, messages, forms, scans and files) are securely deleted.
- You can also ask us to delete everything sooner. It’s deleted after a 7-day window in which you can still cancel the request.
- We keep only what we must: a record that you accepted the agreement, billing records required by law, and a brief note that the deletion happened (no client data). Backups expire on our providers’ normal schedule.
- You’re never locked in, and your clients’ information doesn’t linger once you leave.
10. Your subscription
- CymaTones Practitioner costs $99 per month (plus any applicable taxes), billed monthly in advance through our payment provider, Stripe, for unlimited clients.
- You can cancel at any time from Billing in your portal. Your access continues until the end of the period you’ve paid for, then your data enters the grace period in section 9. Within 7 days of first subscribing, you can cancel from Billing and receive a full refund. After that, fees already paid are not refunded for partial months unless the law requires it.
- We may change the price with at least 30 days’ notice. Complimentary or early-access plans may have their own terms.
11. Payments from your clients
- CymaTones charges you only the platform subscription. Payments between you and your clients happen outside CymaTones: we don’t process them, hold them or take a share, and we aren’t responsible for them.
- You handle your own client pricing, invoices, payments, refunds, taxes and accounting. Any pricing or income guidance in the Platform is general guidance, not financial, tax or accounting advice.
12. Using the CymaTones name
- Your practice leads with your own brand. Your pages and client packets carry a small “Powered by CymaTones Technology” line, which you agree to keep.
- You may say that your practice is powered by CymaTones. You may not present yourself as CymaTones, as employed by, partnered with or endorsed by CymaTones, or alter the CymaTones name or logo.
13. AI features
AI features create drafts and suggestions only. Nothing AI-drafted reaches a client or the public until you review and approve it, and you are responsible for anything you publish or send.
14. Acceptable use
Don’t use the Platform for anything unlawful, harmful, deceptive, harassing or discriminatory; to send spam; to upload malicious code; to copy, scrape or resell the Platform or its content; or to try to access another practice’s data.
15. Indemnification
You agree to defend, indemnify and hold harmless CymaTones and its owners, staff and contractors from and against claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to your practice, your services, your conduct, your content, your client relationships, your breach of this agreement or the Code, or your breach of any law.
16. The Platform is provided “as is”
We work hard to keep the Platform reliable, but it is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including that it will be uninterrupted, error-free or fit for a particular purpose. Features may change as the Platform develops.
17. Limitation of liability
To the fullest extent the law allows, CymaTones will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. CymaTones’ total liability for any claim relating to the Platform or this agreement is limited to the fees you paid CymaTones in the 12 months before the claim.
18. Suspension and termination
- You may stop using the Platform and cancel at any time.
- We may suspend or end your access if you seriously or repeatedly breach this agreement or the Code (for example medical claims, misuse of client data, harm or risk to clients, misrepresenting CymaTones, or non-payment), or where the law requires it. Where it’s reasonable we’ll tell you first and give you a chance to put things right; where clients may be at risk we may act immediately. Section 9 still applies to your data.
19. Following the law
You will follow the laws and rules that apply to your practice where you and your clients are, including licensing, consumer protection, advertising and endorsement rules, privacy and data protection, and tax.
20. Changes to this agreement
We may update this agreement or the Code. We’ll tell you about material changes, and you’ll be asked to accept the new version to keep using the Platform.
