Welcome to CymaTones. These Terms of Service ("Terms") govern your access to and use of the CymaTones website, mobile applications, TV applications (including Fire TV / Amazon Appstore builds), and all related services (collectively, the "Service") operated by CymaTones LLC ("CymaTones," "we," "us," or "our").
By creating an account, accessing the Service, or using our scanners, frequency tracks, or related content, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
You should always consult a qualified licensed healthcare provider for any medical question, condition, or before making changes to your health regimen. Never disregard, avoid, or delay seeking professional medical advice because of something you read, see, or hear on CymaTones.
If you are experiencing a medical emergency, call 911 (U.S.) or your local emergency services immediately. If you are experiencing a mental health crisis, call or text 988 (U.S. Suicide & Crisis Lifeline) or contact your local crisis services.
CymaVoice, CymaVision, CymaTongue, CymaFace, and CymaNails are wellness assessment tools that use bioacoustic frequency analysis and Traditional Chinese Medicine (TCM) frameworks to provide observations about your body's resonance patterns. They are educational and exploratory in nature.
Responses to sound, frequency, and wellness practices are deeply individual. What resonates for one person may not for another. CymaTones makes no guarantee regarding any specific health, wellness, physical, emotional, or spiritual result from using the Service.
You must be at least 18 years old to create an account and use the Service. By using CymaTones, you represent and warrant that you meet this age requirement.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@cymatones.com if you suspect unauthorized access.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
CymaTones is delivered across web, mobile applications, and TV applications. Features include:
Features may change, expand, or be discontinued over time. We will give reasonable notice of significant changes when possible.
Pricing is subject to change; any price change will apply only to subsequent billing cycles for the monthly plan, and you will be notified in advance. One-time Lifetime purchases already completed at a given price are unaffected by future price changes.
Billing is processed through Stripe (our payment processor) using the payment method you provide. By subscribing, you authorize recurring charges to your selected payment method until you cancel. Monthly subscriptions renew automatically each month unless cancelled.
For subscriptions purchased through a mobile or TV app store (e.g., Google Play, Amazon Appstore), billing may be handled by that platform under its own terms. Manage those subscriptions from the corresponding store account.
Individual scan reports may be unlocked via a one-time $3 purchase. This grants permanent access to the full report for the scan you purchased. One-time purchases are separate from subscriptions and do not recur.
You may cancel your monthly subscription at any time from your account settings (which opens the Stripe customer portal) or by contacting support@cymatones.com. Cancellation takes effect at the end of your current billing period. You retain access to paid features until that period ends. Lifetime memberships do not require cancellation and do not renew.
We want you to be satisfied with CymaTones. Our refund policy:
Stripe refunds are issued to the original payment method and typically appear within 5–10 business days.
The Service allows you to create playlists, write journal entries, decorate scrapbook pages, upload photos, record voice affirmations, submit scans, save Symptoms Selector inputs, customize your garden, and share community content (collectively, "User Content").
You retain ownership of your User Content. By submitting User Content, you grant CymaTones a worldwide, non-exclusive, royalty-free license to store, display, transmit, and process that content solely for the purpose of operating, improving, and providing the Service to you. We do not use your User Content to train external AI models.
You represent and warrant that:
Voice affirmation recordings, journal entries, scrapbook layouts, and uploaded scrapbook photos are private and owner-only by default — only you can access them via your authenticated account.
Certain features are opt-in public: public gardens, shared playlists, community shop listings, and community keepsakes may be visible to other members of the CymaTones community. You are responsible for what you share. We reserve the right to remove or hide any public content that violates these Terms.
You agree not to:
All content on the Service — including frequency tracks, audio files, scanners, reports, branding, logos ("CymaTones," "CymaVoice," "CymaVision," "CymaTongue," "CymaFace," "CymaNails," "CymaSonic," "GoldHeart," "Cosmos"), proprietary algorithms, prescription systems, and accompanying educational materials — is the property of CymaTones LLC or its licensors and is protected by copyright, trademark, patent (pending), and other intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only. All rights not expressly granted are reserved.
The Service integrates with third-party services including (but not limited to):
Your use of these third-party services is subject to their respective terms and privacy policies. CymaTones is not responsible for the practices of third parties.
CymaTones is delivered as a website, a mobile application, and a TV application. When you download or use the CymaTones mobile app or TV app from a third-party app store (e.g., Google Play, Amazon Appstore), you also agree to that store's end-user license agreement and terms. Those terms apply alongside these Terms; where they conflict for platform-specific matters (e.g., store-billed subscriptions, install/uninstall, device permissions), the store's terms control.
Microphone and camera permissions on mobile and TV apps are used only for scan and affirmation features you explicitly initiate. You may revoke these permissions from your device settings at any time; some features will not function without them.
You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive behavior, or as required by law.
Upon termination, your right to access the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will remain in effect.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
CymaTones does not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYMATONES AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID CYMATONES IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless CymaTones, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any claim that your User Content caused damage to another party.
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any dispute arising out of or related to these Terms or your use of the Service shall first be attempted to be resolved informally by contacting support@cymatones.com.
If we cannot resolve the dispute informally within 60 days, any dispute, controversy, or claim shall be finally resolved by binding arbitration administered by JAMS under its then-applicable rules, in El Dorado County, California, or another mutually agreed location. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
Class action waiver: You and CymaTones agree that any dispute will be brought in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
If this class action waiver is found unenforceable, then the entire arbitration provision will be void. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, notify you via email and/or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
